Much of the case for the initiative rests on claims about what current Idaho law does. Many of those claims are myths. Here is what the law actually says.
Current Idaho law is more careful and more permissive in genuine emergencies than the initiative’s supporters often suggest.
Supporters of the initiative often argue that Idaho’s current law has harmed women and driven doctors away. The available evidence points the other direction.
Why this matters for the vote. If contraception, IVF, miscarriage care, and treatment of life-threatening emergencies are already legal and private in Idaho, then the initiative is not needed to protect them. What the initiative would actually change is the set of common-sense limits on abortion — including parental consent, informed consent, and physician and facility requirements.
